Climate Change Bill (Proposed)

The Ministry of Natural Resources and Environmental Sustainability (“MNRES”) is preparing a Climate Change Act that is expected to be submitted to Malaysia’s Parliament in 2025. The Climate Change Act will act as an umbrella legislation that governs all climate change-related issues and applies throughout Malaysia. 

According to a consultation document published by the MNRES, the Act will contain various new provisions relating to GHG emissions, in particular: the creation of a National Integrated Climate Data Repository for the collection and disclosure of climate-related data and information; the creation of a Measurement, Monitoring, Verification and Reporting (MMRV) framework with mandatory data inputs from various sectors of Malaysia’s economy (including the energy sector); the establishment of a Domestic Emissions Trading Scheme with an emission threshold at the facility-level; and the creation of a National Climate Fund to support climate  change initiatives and low carbon development. A new regulatory authority will be created within the MNRES for the purpose of administering, implementing and enforcing the Act.
