Penalty:In addition to enforcement provisions of the regulation, there is an Administrative Penalty Regulation.

Regulated facilities must reduce their emissions intensity from an established baseline.  Compliance options include:

  • Purchasing offset credits;
  • Emissions performance credits;
  • Technology fund credits (at a price of $15/tonne of CO2e);
  • Performance improvements. 

The exact quantitative effect on energy efficiency is not readily available, but decreased emissions intensity should generally correlate to increased energy efficiency.
