Act 11245: The Energy Efficiency and Conservation Act

Full name: Act 11245: An Act Institutionalizing Energy Efficiency and Conservation, Enhancing the Efficiency Use of Energy, and Granting Incentives to Energy Efficiency and Conservation Projects.

 

  • Department of Energy (DOE) has been tasked with creating a National Energy Efficiency and Conservation Plan (NEECP).
  • A National Energy Efficiency and Conservation Database holding information on energy consumption and the application of energy efficient and renewable energy technologies, will also be established.
  • All government agencies are directed to ensure efficient use of energy in their offices, facilities and transportation units. Local government units must also establish Local Energy Efficiency and Conservation Plans.
  • Creates an inter-agency energy efficient and conservation committee to evaluate and approve government energy efficiency projects. The committee will also provide strategic direction in the implementation of the Government Energy Management Program that seeks to reduce monthly consumption of electricity and petroleum products.
  • The DOE must also develop Minimum Energy Performance Standards (MEPS) for energy-consuming products.
  • Obliges vehicle manufacturers and dealers to comply with government fuel economy standards.
  • Fiscal incentives for efficiency will be included in the annual investment priorities plan of the Board of Investments.
  • Awards will be created for energy efficiency innovations.
  • Penalties for failure to comply with energy labeling, removal or altering energy label on energy-consuming product, failing to provide accurate energy information, selling, leasing or importing energy-consuming products that don’t comply with MEPS, among others.
  •  Anyone who willfully violates the law will suffer a penalty of one year to five years imprisonment or a fine between P100,000 to P100 million if convicted in court.
