The Decree replaces attachments I, II and III of the previous Legislative Decree N°20 of Febryary 8th, 2007 and provides some integrations to the computation methodology for the energy from high efficiency cogeneration.

In particular, it awards to electricity produced from High Efficiency Cogeneration several benefits; the most important are:


• Exemption from the requirement to purchase green certificates (obligation that generally exists for electricity produced from non-renewable sources).
• The right for priority dispatching, following the rules for electricity from renewable sources.
• Right to access the "net metering" service (for systems with nominal power not exceeding 200 kW). Thanks to this service, a producer who is producing electricity in excess of its needs can feed the exceeding energy into the public grid: he will withdraw it later, when the operating conditions will change and his request of electricity will exceed his own production.
• The award of energy efficiency certificates (White Certificates), in numbers that reflect the primary energy savings achieved annually.
• The award of Green Certificate (only for High Efficiency Cogeneration systems associated with district heating, and provided that certain requirements are met regarding the date of entry into operation, or in the case of plants used in agriculture.
• Simplified procedure for grid connection, and reduced connection charges.
• Simplified authorization procedure for building and operation (only for installations of less than 1 MWe).
• Special treatment with regard to the transmission and distribution electricity cost, and the purchase of backup or integration services.
