Legal References:Law 7200
Description:

The Law regulates utility-scale private sector projects in Costa Rica. It states that utility-scale renewable energy projects can opt for one of the following three types of contracts:

  • Direct contracts for projects under 20 MW;
  • Auctions for projects up to 50 MW;
  • Legislative approval for projects greater than 50 MW.
Amended:

Law 7508 (Reform of the Law that Authorises Autoproducers-May 9th, 1995) reforms Law 7200 (Law Authorising Power Generation Autoproduction) to establish auctions for renewable energy projects up to 50 MW, with PPAs for up to 20 years.

Projects participating must submit a bid guarantee, a construction guarantee of 4% of the project cost and, once in operation, a contract guarantee of 1% of the project cost for the duration of the contract.

The regulation 24866 of 1995 establishes the requirements that regulate the purchase of Electric energy tendered, under the provisions of Article 20 of Law No. 7200 and its reforms (law No. 7508).
